5. The Services

5.1 Free Check

5.1.1 The Free Check provides a basic summary of publicly available vehicle data for any UK-registered vehicle, identified by its VRM. The data categories included are specified on the Platform and may be updated at any time.

5.1.2 The Free Check is provided for general informational purposes only. It is not a comprehensive vehicle history report and must not be relied upon as the sole basis for any vehicle purchase decision.

5.2 Full Check Report

5.2.1 The Full Check is a paid service that generates a vehicle history Report for the VRM or VIN entered by you. Each Full Check requires the redemption of one Check Credit.

5.2.2 The Report is compiled from data obtained from Third-Party Sources, including Percayso Inform, UKVD and Vehicle DNA. Data categories that may be included in a Report include, without limitation:

  • MOT history, test outcomes, advisory notes and mileage records;
  • Mileage history and discrepancy indicators;
  • Outstanding finance and encumbrance status;
  • Insurance write-off status and category;
  • Stolen vehicle status;
  • Number of registered previous keepers and keeper change history;
  • Number plate change history;
  • Vehicle specification and factory-fitted options (decoded from VIN);
  • Similar vehicle market listings and historic sale events;
  • Market demand indicators;
  • Insurance risk group classification;
  • Vehicle images associated with the VRM;
  • Safety recall status; and
  • DVLA registration data including colour, engine size, fuel type and tax status.

5.2.3 Data availability varies by vehicle make, model, age, country of original registration and applicable legal or technical restrictions. Not all categories will contain data for every vehicle. A Report reflects only what is held by the relevant Third-Party Sources at the time of generation.

5.2.4 Reports are normally generated within a few minutes of purchase. If you have not received your Report within 24 hours, please contact us at support@vehicleinsight.co.uk.

5.2.5 Once a Check Credit has been used to generate a Report, the Service is considered fully delivered in respect of that Credit.

5.2.6 Unused Check Credits are valid for 12 months from the date of purchase. After this period, unused Credits expire and are removed from your Account without refund.

5.3 AI Chatbot

5.3.1 Full Check Reports include access to an AI Chatbot that allows you to ask questions about the data contained in your specific Report.

5.3.2 The AI Chatbot is configured solely to respond to questions about the data in the Report to which it is attached. It has no access to external data, real-time information or data from any other report or vehicle.

5.3.3 AI Chatbot responses are automated and are provided for reference purposes only. They do not constitute professional, legal, financial, mechanical or insurance advice and must not be relied upon as such.

5.3.4 We do not warrant the accuracy or completeness of AI Chatbot responses. You should always verify important information directly from the Report data and from independent sources before making any decision.

5.4 Platform Availability

5.4.1 We will use reasonable endeavours to keep the Platform available. However, access may be temporarily interrupted for planned maintenance, emergency technical work or events beyond our reasonable control. We will notify you of planned maintenance where reasonably practicable.

6. Nature and Limitations of Reports

The Report is an informational document only. Reports are compiled from third-party data and are provided strictly for reference and informational purposes. We do not verify the accuracy of underlying third-party data and accept no responsibility for any decision made, or loss suffered, in reliance on a Report. A Report is not a substitute for physical vehicle inspection, professional advice or independent verification. You must carry out your own due diligence before purchasing any vehicle.

6.1 We compile Report data from Third-Party Sources. We do not independently generate, verify or control the data held by those sources. The completeness, accuracy and currency of any Report is entirely dependent on what information is held by and available from the relevant Third-Party Sources at the time the Report is generated.

6.2 A Report reflects a vehicle's history only to the extent that data is available to us at the time of generation. Events or circumstances not recorded by any relevant Third-Party Source will not appear in the Report.

6.3 We make no representation or warranty — express or implied — that any Report is complete, accurate, current or fit for any particular purpose.

6.4 A Report must not be used as the sole basis for any decision to purchase or decline to purchase a vehicle. We strongly recommend that, in addition to obtaining a Report, you:

  • inspect the vehicle in person and test drive it;
  • inspect the vehicle's V5C logbook and confirm it matches the vehicle and Report details;
  • arrange an independent physical inspection by a qualified mechanic or approved inspection service;
  • verify outstanding finance directly with the relevant finance company;
  • contact the DVLA or relevant authority to verify registration details; and
  • check any safety recalls directly with the vehicle manufacturer or at gov.uk/check-vehicle-recall.

6.5 Where a Report indicates that a vehicle may have outstanding finance, this information should be independently verified with the relevant finance company before any purchase is made. We cannot confirm whether any finance has since been settled.

6.6 If a Full Check Report is generated and contains no data in its core sections due to a genuine absence of records held by Third-Party Sources at the time of generation, that Report may be designated a report without records and the Check Credit used to generate it will be returned to your Account. Please contact us at support@vehicleinsight.co.uk if you believe your Report qualifies.

6.7 If you believe any information in your Report is inaccurate, please contact us at support@vehicleinsight.co.uk. We will take reasonable steps to investigate and seek to correct the Report or provide an appropriate remedy where an inaccuracy is confirmed.

7. Your Relationship with the Vehicle

7.1 Before purchasing a Full Check Report, you will be asked to confirm the purpose of your check and your relationship to the relevant vehicle. You may only purchase a Report if you have a genuine and lawful interest in that vehicle, for example:

  • you are considering purchasing the vehicle;
  • you own the vehicle and wish to check its history;
  • you are acting on behalf of someone considering purchasing the vehicle, with their knowledge and consent; or
  • you have another legitimate reason to carry out a vehicle background check.

7.2 You must only select the relationship option that accurately reflects your circumstances. Providing false or misleading information at the point of purchase is a material breach of these Terms.

8. Permitted Use of the Platform and Reports

8.1 Reports are provided to you for personal, non-commercial reference use only. You may share the content of a Report with a third party in connection with a specific vehicle evaluation — for example, when negotiating a private purchase — but you may not sell, sublicense or distribute Reports commercially.

8.2 You must not use the Platform or any Report for any commercial purpose without our prior written consent. This includes reselling Report data, incorporating it into any product or service, or using it within an automated commercial process.

8.3 In using the Platform, you agree that you will not:

  • use any automated tool, bot, scraper or equivalent process to access or copy any part of the Platform or its data;
  • attempt to gain unauthorised access to any part of the Platform, its servers, databases or networks;
  • reverse engineer or attempt to extract the source code of any part of the Platform;
  • take any action that interferes with the proper operation of the Platform or places an unreasonable load on its infrastructure;
  • introduce any virus, malicious code or harmful material to the Platform; or
  • use the Platform for any unlawful purpose or in any way that infringes the rights of any third party.

9. Purchasing, Pricing and Cancellation

9.1 Check Credits

9.1.1 Full Check Reports are purchased by acquiring Check Credits, which may be bought individually or in bundles. A Credit is used when you enter a VRM or VIN to generate a Report, at which point the Service is considered fully delivered and the Credit is non-refundable, except as described in Section 6.6 or on valid cancellation under Section 9.3.

9.1.2 Unused Check Credits expire 12 months from the date of purchase and are removed from your Account without refund.

9.2 Pricing and Payment

9.2.1 All prices shown on the Platform are inclusive of VAT where applicable. The price payable is the price displayed at the time you confirm your order.

9.2.2 Payment may be made by credit card, debit card or other methods made available on the Platform from time to time. Payment must be made in full at the point of purchase.

9.2.3 We may offer promotional discount codes from time to time. Codes must be applied at the point of purchase and cannot be applied retrospectively.

9.2.4 Invoices are available to download from your Account until the tenth day of the calendar month following the month of purchase.

9.3 Your Right to Cancel — Private Users

9.3.1 If you are a Private User, you have the right to cancel your purchase of Check Credits within 14 calendar days of the date of purchase without giving a reason, provided that no Credits have been used during that period.

9.3.2 To cancel, please email support@vehicleinsight.co.uk within the cancellation period with your name, Account email address, order reference number and a clear statement that you wish to cancel. Further information is set out in Annex A.

9.3.3 Once a Check Credit has been used to generate a Report, the right to cancel does not apply to that Credit, as the Service is considered to have been fully delivered at that point. By clicking to generate a Report, you expressly acknowledge this.

9.3.4 Where a bundle is partially used, any refund will be calculated proportionally based on unused Credits, after deduction of any bundle discount applied, in accordance with applicable law.

9.3.5 Valid refunds will be processed within 14 calendar days of receipt of your cancellation notice, using the same payment method as the original purchase.

9.4 Commercial Users

9.4.1 The 14-day right of cancellation does not apply to Commercial Users. Refund terms for Commercial Users are at our discretion or as set out in any separate written agreement.

10. Intellectual Property

10.1 All content on the Platform — including the domain name, design, code, trade marks, logos, data compilations, analytics, text and presentation formats — is owned by or licensed to us and is protected by applicable intellectual property law.

10.2 You may access and use the Platform and Reports solely for the purposes permitted under these Terms. You must not copy, reproduce, adapt, distribute, sell, sublicense or create derivative works from any part of the Platform or any Report without our prior written consent.

10.3 Third-party trade marks, data and other intellectual property appearing on the Platform or in Reports — including those of Percayso Inform, UKVD and Vehicle DNA — remain the property of their respective owners.

11. Suspension and Termination

11.1 We may suspend or terminate your Account and access to the Services at any time if you have:

  • breached any provision of these Terms;
  • provided false information about your relationship with a vehicle at the point of purchase;
  • used the Platform for any fraudulent, unlawful or unauthorised purpose;
  • resold or commercially exploited any Report without our written consent; or
  • used any automated tool or process to access or scrape the Platform.

11.2 Where we terminate your Account for breach of these Terms, we will notify you by email. Unused Check Credits in your Account at the time of termination for cause will be forfeited without refund.

11.3 You may terminate your Account at any time under Section 4.4. Voluntary termination does not entitle you to a refund of unused Credits outside the cancellation window in Section 9.3.

12. Disclaimer and Limitation of Liability

Reports are provided strictly on an 'as is' and 'as available' basis. We make no warranty — express or implied — as to the accuracy, completeness, currency or fitness for purpose of any Report or data contained within it. We accept no responsibility for any outcome, loss or damage arising from reliance on a Report.

12.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

12.2 Subject to Section 12.1, and to the fullest extent permitted by applicable law:

  • We accept no liability for any loss, damage or expense arising from your reliance on any Report, Free Check, AI Chatbot response or any other content or information provided via the Platform;
  • We accept no liability for any inaccuracy, incompleteness or absence of data in any Report, where such inaccuracy, incompleteness or absence arises from data held by or absent from Third-Party Sources;
  • We accept no liability for any indirect, consequential, special, punitive or economic loss, including loss of profit, loss of data, loss of opportunity or loss arising from a vehicle purchase decision made in reliance on a Report; and
  • Our total aggregate liability to you in connection with any Report or Service shall not exceed the amount actually paid by you for the relevant Report or Service.

12.3 Reports are informational documents only. They are not professional advice of any kind. We are not a vehicle inspection service, a finance broker, an insurance provider or a legal adviser. Nothing in any Report or AI Chatbot response constitutes advice of any kind, and nothing should be treated as such.

12.4 The Platform may contain links to third-party websites. These are provided for convenience only. We have no control over and accept no responsibility for the content or availability of any third-party site.

12.5 These Terms do not affect any statutory rights you may have as a consumer under applicable law, including the Consumer Rights Act 2015.

13. Personal Data and Privacy

13.1 We process your personal data in accordance with our Privacy Policy. Please read the Privacy Policy carefully before using the Platform.

13.2 By creating an Account or purchasing a Service, you acknowledge that we will collect and process your personal data as described in the Privacy Policy, including your name, email address, payment information and vehicle search data.

13.3 We implement appropriate technical and organisational security measures to protect your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

13.4 Where you use the Services as a Commercial User or on behalf of a legal entity, we and you act as independent data controllers. Each party is separately responsible for compliance with applicable data protection law in relation to its own processing activities.

14. Changes to These Terms

14.1 We may update these Terms from time to time to reflect changes in law, our Services or our operational requirements.

14.2 We will give registered Users at least 14 calendar days' notice of any material changes, either by email to your registered address or via a prominent notice on the Platform.

14.3 If you do not agree with any proposed changes, you may close your Account before they come into effect. You should use any remaining Credits before closing your Account.

14.4 Continued use of the Platform after updated Terms have come into effect constitutes acceptance of the changes.

14.5 Changes will not apply retrospectively to Reports or Credits purchased before the effective date of the change.

15. Complaints and Dispute Resolution

15.1 If you are unhappy with any aspect of our Services, please contact us in the first instance at support@vehicleinsight.co.uk. We will acknowledge your complaint within 5 working days and aim to resolve it within 28 working days.

15.2 If you are a Private User and are not satisfied with our response, you may refer your complaint to an accredited Alternative Dispute Resolution (ADR) provider. A list of approved providers is available from the Chartered Trading Standards Institute at www.tradingstandards.uk. Referral to ADR does not affect your right to bring a claim in the courts.

15.3 These Terms are governed by the law of England and Wales. The courts of England and Wales shall have jurisdiction to resolve any dispute, subject to your right as a consumer to bring proceedings in the courts of your place of residence.

16. General

16.1 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Platform and Services, and supersede all prior agreements and understandings on the same subject.

16.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, it will be severed and the remaining Terms will continue in full force.

16.3 Assignment. We may assign our rights and obligations under these Terms to a third party without your consent, provided this does not adversely affect your rights. You may not assign your rights or obligations under these Terms without our prior written consent.

16.4 Waiver. A failure by us to exercise any right under these Terms is not a waiver of that right.

16.5 Third Party Rights. No person other than you and us has any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any Term.

16.6 Notices. Notices from us to you will be sent to your registered Account email address or posted on the Platform. Notices to us should be sent to support@vehicleinsight.co.uk.
